Rules and Policies

The Clubs of 365 Grand Club including 365 Grand Properties, L.L.C. and The Club at 365 Grand Club, a Colorado limited liability company (“Club”), has established the following rules (“Club Rules”) to govern the use of all Club facilities and to promote the health, safety, welfare, and enjoyment of all persons using the Club facilities. The Clubs may, in sole discretion, amend these Club Rules from time to time. Amendments will be effective when posted at the Clubs or mailed to the members. These Club Rules shall apply to all persons using both Club facilities, whether a member, designee, other authorized user or guest. Capitalized terms used in these Club Rules shall be defined as set forth in the Membership Policies for 365 Grand Properties and The Sports Club at 365 Grand Club. The Membership Director shall be the Club’s representative for purposed of implementing and enforcing these Club Rules.

Hours of Operation:
The facilities of the Clubs of 365 Grand Club are available for use only during such operating hours as the Club determines and publishes from time to time. The Club may close portions of the Club facilities during normal operating hours for scheduled maintenance and repairs and the Club may restrict or reserve the use of portions of the Club facilities for special events or private parties during normal operating hours from time to time.

Membership Cards:
The Clubs may issue membership cards to each Member or designee and authorized user, identifying the authorized holder and the sponsoring member, if applicable, the category of membership, and the member’s account number. Membership cards shall be carried at all times while using the Clubs facilities. A membership card may be used only by the person to whom it is issued.
In the event that a membership card(s) is lost or stolen:

  • The person to whom it was issued shall immediately notify the Club so that the account may be canceled and a new number and card(s) issued.
  • The Member shall be responsible for all charges placed on the account prior to the Club’s receipt of notice of the lost or stolen membership card(s).
  • The Club may charge a card replacement fee in an amount determined by the Club for replacement of each lost or stolen membership card, or for otherwise changing a club account number.
  • ALL membership cards are the property of the Clubs of 365 Grand Club and may be surrendered to the Club upon termination of the membership for which they were issued.

Club Accounts:
All food, beverage and other purchases charged to a Member’s Club account will be billed monthly and shall be considered delinquent if not paid within thirty (30) days after receipt of the monthly statement, or by the end of the month in which the statement was received. The Clubs of 365 Grand Club may charge a service charge on all past due balances in the amount of one and one-half (1.5%) per month from the date of the statement until paid in full.

Notices:
Each Member shall give written notice to the Club of the Member’s mailing address to which the Club should redirect all notices and invoices. Failure to notify the Club of an address change shall be considered a waiver to the right to receive notices and other communications from the Club.
Members who may be resigning the Club, for any reason, are required to provide the Club a minimum of thirty (30) days advanced written notice of said resignation. Monthly dues are billed in advance. As such, such written notice of a resignation be received prior to the 15th of said month, the Member will be required to pay the monthly dues for that month and will not have dues prorated for thirty (30) days from receipt of said notice. Should the Club receive written notice after the 15th of said, the Member will be required to pay one (1) additional month of dues prior to the resignation taking effect.
Each Member owning property in the Community, shall notify the Club in writing within seven (7) days after the transfer of title to such property, identifying the name and address of the new owner and the date of transfer of title. All such notices shall be in writing and shall be accompanied by the member’s membership certificate and all membership cards issued on the member’s account.

Food and Beverage Services:

  • Alcoholic beverages will be sold and served and may be consumed on the Club premises only as permitted by the Colorado law and local ordinances.
  • The Club reserves the right in its sole discretion, to refuse service to any person who appears to be intoxicated.
  • No alcoholic beverages sold on the Club premises may be removed from the premises.
  • Except as the Club may otherwise specifically authorize, all alcoholic beverages consumed on the Club premises must be purchased from the Club.
  • Outside catering, picnics, and “brown bagging” are not permitted.
  • No person shall bring or consume food or beverages on the Club premises except those furnished by the Club without prior authorization from the Club (other than as needed for infants).
  • Employees may not deliver food or alcoholic beverages to locations away from the immediate area where sold except in the case of catering arranged through the Membership Director.

Advertisements and Solicitations:

  • No person shall post or circulate commercial advertisements or petitions on the Club premises or use the Club’s membership roster for any purpose other than official Club business without the
  • Club’s prior approval.
  • No person shall give the Club’s membership roster to anyone who is not a Member or an employee of the Club for any reason other than official Club business.

Club Personnel and Operations:

  • No person other than the Club and its designees shall supervise, give direction to, or reprimand Club employees. Verbal or physical abuse or harassment of employees will not be tolerated.
  • No person shall request special favors or special series from Club employees or send any employee off of the Club premises for any reason without prior permission of the Club Manager. No person shall request use of Club equipment, supplies, or services not normally made available for use by Members.
  • To facilitate the proper management of the Club facilities, all complaints, criticisms or suggestions of any kind relating to any Club operations or personnel should be in writing, signed, and addressed and delivered to the Club.

Gratuities:

  • For the convenience of all Members and authorized users of the Club facilities, a 15% gratuity may automatically be added to all food and beverage sales (20% banquet sales) and will distributed to the service personnel. Members should feel free to increase this gratuity as they feel appropriate.

Children:

  • The Club may post policies at each facility prohibiting use by persons under a specified age, or restricting use by children under a specified age unless accompanied and supervised by an adult, which policies shall be observed at all times unless otherwise approved by the Club Manager. Children under the lawful drinking age are not permitted in any bar area unless accompanied and supervised by an adult.
  • Children under 18 years of age are not allowed to use the Club facilities after 10:00 p.m. without the express permission of the Club Manager unless accompanied by an adult.
Any person who brings a child onto Club facilities is responsible for the child’s conduct and safety while on the premises.

Attire:

  • All persons using the Club facilities are expected to dress in a manner consistent with the specific dress policies published or posted by the Club from time to time for particular areas and activities.
  • Members are responsible for advising their guests as to appropriate dress.
For use of the Club’s food and beverage facilities, or during Member events, appropriate dress will be announced in the monthly calendar.
  • Shirts and shoes shall be worn at all times on the Club premises, except in pool areas. No bathing suits are permitted outside the pool areas unless covered with appropriate attire.

Animals:

  • Dogs (other than eye seeing dogs) and other pets are not permitted on the golf course or any other portion of the Club premises, except under special circumstances when authorized by the Club.
  • Any person who brings an animal onto the Club premises is responsible for any damage caused by the animal.

Club Property:
No person shall remove any Club property or furniture from the Club premises or the area in which it belongs without permission of the Club.

Personal Property:

  • Each Member, as a condition of membership, and each designee, authorized user and guest, as a condition of invitation to the Club facilities, assumes the sole responsibility for his or her personal property.
  • The Club shall not be responsible for any loss or damage to any personal property used or stored on the Club premises.
  • Any such personal property which is left in or on the Club facilities for six (6) months or more may be sold by the Club, with or without notice, at a public or private sale, or may be otherwise disposed of, and the proceeds, if any, shall belong to the Club.

Liability for Use of Club Facilities; Assumption of Risk:

  • Members of the Club shall be liable for any property damage and/or personal injury at the Club, or at any activity or function operated, organized, arranged or sponsored by the Club, caused by the Member, its designee, authorized users or guests. The cost of repairing any such property damage shall be charged to the responsible Member’s club account.
  • Any Member, designee, authorized user or guest who, in any manner, makes use of or accepts the use of any apparatus, equipment, facility, privilege, or service whatsoever owned, leased or operated by the Club, or who engages in any tournament, game, function, special event, exercise, competition or other activity operated, organized, arranged or sponsored by the Club, either on or off the Club’s premises, does so at his or her own risk and agrees that the Club shall have no liability for personal injury or damage to personal property occurring in the course of or arising out of such use.

Parking:
Vehicles shall be parked only in paved areas designated for parking. “No Parking” signs and reserved parking designations must be observed. Violators may be towed at the vehicle owner’s expense.

Smoking:
Smoking is not permitted inside the clubhouse or in any area where food and beverage is serviced. Designated areas outside have been provided for smoking.

Weapons:
No firearms or other weapons of any kind are permitted on the Club premises at any time except those, if any, that police officers and other public servants and security personnel may be required to carry while on duty.

Non-Discrimination Policy:
Club employees shall not discriminate against any individual because of the individual’s race, religion, creed, color, sex, nation origin, age, physical disability, or marital status.
